1. Agreement to Terms
By accessing or using TrustKeeper services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Services.
2. Description of Services
2.1 What Moon One LLC Provides
Moon One LLC ("Company", "we", "us", or "our") provides:
- The TrustKeeper website and user interface
- Infrastructure for accessing the TrustKeeper network
- Customer support and documentation
- Optional hosted services and premium features
2.2 What Moon One LLC Does NOT Provide or Control
IMPORTANT: The TrustKeeper protocol operates on decentralized, permissionless infrastructure that is NOT owned, operated, or controlled by Moon One LLC.
This includes:
- Smart contracts deployed on public blockchains
- Distributed storage networks (IPFS, Arweave, or similar)
- Peer-to-peer network nodes operated by third parties
- Cryptographic key generation and management (performed locally on your device)
- Data encrypted and stored on distributed networks
The decentralized protocol exists independently of Moon One LLC and will continue to function regardless of the Company's operations.
3. User Responsibilities
3.1 Key Management
You are solely responsible for:
- Generating, securing, and backing up your cryptographic keys
- Maintaining access to your recovery phrase or backup keys
- All actions taken using your keys
WARNING: Lost keys cannot be recovered by Moon One LLC or anyone else. There is no "forgot password" option for cryptographic keys.
3.2 Data You Store
You acknowledge that:
- Data you encrypt and store on distributed networks is your sole responsibility
- Once data is written to decentralized storage, it may be permanent and immutable
- Moon One LLC cannot access, modify, delete, or recover your encrypted data
- You must comply with all applicable laws regarding data you store
3.3 Prohibited Uses
You agree not to use the Services to:
- Store illegal content
- Violate any applicable laws or regulations
- Infringe on intellectual property rights
- Distribute malware or harmful code
- Engage in any activity that could harm the network or other users
4. Disclaimers
4.1 Decentralized Infrastructure
THE DECENTRALIZED PROTOCOL AND DISTRIBUTED INFRASTRUCTURE ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. MOON ONE LLC:
- Does not guarantee uptime or availability of decentralized networks
- Cannot guarantee data persistence on third-party infrastructure
- Has no ability to reverse, modify, or censor transactions on public blockchains
- Cannot recover lost or stolen cryptographic keys
- Is not responsible for smart contract bugs or vulnerabilities
4.2 No Custody
Moon One LLC NEVER has custody of:
- Your private keys
- Your unencrypted data
- Your passwords or recovery phrases
All encryption happens locally on your device before any data leaves your control.
4.3 Third-Party Networks
The Services interact with independent third-party networks including but not limited to:
- Ethereum, Polygon, Base, or other blockchain networks
- IPFS, Arweave, or other distributed storage networks
- Various node operators and validators
Moon One LLC is not responsible for the operation, availability, or security of these independent networks.
5. Limitation of Liability
5.1 Maximum Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOON ONE LLC'S TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
5.2 Exclusion of Damages
IN NO EVENT SHALL MOON ONE LLC BE LIABLE FOR:
- Loss of data stored on decentralized networks
- Loss of access due to lost cryptographic keys
- Actions of third-party network operators
- Smart contract failures or exploits
- Unauthorized access resulting from compromised keys
- Any indirect, incidental, special, consequential, or punitive damages
6. Indemnification
You agree to indemnify and hold harmless Moon One LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:
- Your use of the Services
- Your violation of these Terms
- Your violation of any applicable laws
- Data you store on decentralized networks
- Your failure to secure your cryptographic keys
7. Intellectual Property
7.1 Open Source Code
The TrustKeeper protocol code is open source and licensed separately. These Terms do not restrict your rights under applicable open source licenses.
7.2 Company Property
The TrustKeeper name, logo, website design, and documentation are property of Moon One LLC.
8. Modifications
We reserve the right to modify these Terms at any time. We will provide notice of material changes by:
- Posting the updated Terms on our website
- Updating the "Last Updated" date
Your continued use of the Services after changes constitutes acceptance of the modified Terms.
9. Termination
9.1 By You
You may stop using our Services at any time. Your encrypted data on decentralized networks will remain accessible using your keys.
9.2 By Us
We may suspend or terminate your access to our hosted services for violation of these Terms. This does not affect your ability to interact directly with the decentralized protocol.
10. Governing Law
These Terms shall be governed by the laws of the State of Wyoming, United States, without regard to conflict of law principles.
11. Dispute Resolution
Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Wyoming, United States.
12. Severability
If any provision of these Terms is found unenforceable, the remaining provisions shall continue in full force and effect.
